Yervana Content Standards

These Content Standards are made pursuant to the Yervana Terms of Service, which govern the use of Yervana, including any content, functionality and services offered on or through www.yervana.com or any other website through which Yervana makes its services available (the “Website”), and to any mobile, tablet and other smart device applications, and application program interfaces (the “Application”) (collectively, the “Services”). All Adventures booked via the Services create an Agreement between registered users seeking adventures (“Explorers”) and other registered users offering authentic adventures in the community (“Locals”). Locals can use the Services to publish experiences and excursions in their fields of expertise (“Adventures”), which can then be booked by Explorers who wish to participate in that Adventure.

Your access to and use of the Services is conditioned upon compliance with the Terms of Service and your understanding and agreement that the Company is merely a facilitator providing an online marketplace connecting users, and that the Company is not a participant in any relationship between users, Locals or Explorers, nor is it a party to any contractual relationship between a Local and an Explorer.

These Content Standards are incorporated into, and form part of the Terms of Service, and any Explorer or Local participating in any Adventure offered through the Services, is bound to adhere to these Content Standards. Any terms not defined herein have the meaning given to them in the Terms of Service.

1. Content Standards

1.1 The content standards set out in this paragraph (the “Content Standards”) apply to any and all User Content and interactive services. User Content must comply with all applicable federal, provincial, state, local and international laws and regulations. Without limiting the foregoing, User Content must not:

1.1.1 contain any material which is defamatory, libelous, tortuous, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, invasive of another’s privacy or otherwise objectionable;

1.1.2 be fraudulent, false, misleading (directly or by omission or failure to update information) or deceptive;

1.1.3 promote discrimination, bigotry, racism, hatred, harassment or harm against any individual or group and must not discriminate in any way based on race, national origin, religion, gender, sexual orientation, disability, medical condition, marital status, age or gender identity, including declining a Explorer or imposing upon them different standards and conditions on the basis of the foregoing or posting any statements or listings that discourage or indicate a preference for or against any Explorer on account of any of the foregoing;

1.1.4 promote sexually explicit or pornographic material, or violence or actions that are threatening to any person;

1.1.5 promote illegal or harmful activities or substances;

1.1.6 infringe any patent, trademark, trade secret, copyright or other intellectual property rights of any other person, including without limitation the Company;

1.1.7 violate the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms;

1.1.8 be likely to deceive any person, including the Company;

1.1.9 promote any illegal activity, or advocate, promote or assist any unlawful act;

1.1.10 cause annoyance, inconvenience or needless anxiety or be likely to upset, embarrass, alarm or annoy any other person;

1.1.11 be used to impersonate any person, or to misrepresent your identity or affiliation with any person or organization;

1.1.12 contain personally identifiable information not belonging to you, including any personal information belonging to minors;

1.1.13 involve commercial activities, sales, bartering or advertising, including company names, logos or links, contests, sweepstakes and other sales promotions;

1.1.14 give the impression that such User Content emanates from the Company or any other person or entity, if it is not the case; or

1.1.15 if it is a comment or review, incentivize by a promise for payment, additional services or a discounted rate or motivate by a threat or extortion.

1.2 The Company reserves the right to remove or disable access to any User Content that it finds to be in violation of these Terms or any of the Company’s current Policies and standards, or if it deems the User Content to be otherwise harmful or objectionable to the Company, its users or any third parties.

2. General

2.1 The Company reserves the right, at its sole discretion, to modify or replace these Content Standards at any time.
