Adventure Out West – CONTEST RULES (the “Contest”)
THIS CONTEST IS ONLY OPEN TO CANADIAN RESIDENTS (EXCLUDING QUEBEC) AND IS GOVERNED BY CANADIAN LAW AND THE LAWS OF THE PROVINCE OF BRITISH COLUMBIA.
NO PURCHASE NECESSARY. SEE BELOW FOR FULL CONTEST DETAILS. PARTICIPATION IN THIS CONTEST CONSTITUTES YOUR FULL AND UNCONDITIONAL ACCEPTANCE OF, AND AGREEMENT TO BE LEGALLY BOUND BY, THESE CONTEST RULES (THE “CONTEST RULES”).
CONTEST PERIOD
The Contest begins on Wednesday, April 20, 2022 at 10:00 a.m. Pacific Time (“PT”) and ends on Monday May 23, 2021 at 23:59 p.m. PT (the “Contest Period”).
ELIGIBILITY
The Contest is open to all residents of Canada (excluding Quebec) who have reached the age of majority in their province or territory of residence at the time of entry, except employees (and those with whom such employees are domiciled) of Yervana (the “Sponsor”). The chances of winning depend on the total number of eligible entries received.
HOW TO ENTER
NO PURCHASE NECESSARY. To be eligible, your Entry must be submitted and received within the Contest Period. All eligible Entries submitted and received during the Contest Period will be entered into the random prize draw. You may not enter if you are an employee, representative, mandatary, officer or director of Yervana or the immediate family (spouse, parents, siblings and children) or household member of an Yervana employee, representative, mandatary, officer or director
In order to enter, Eligible Participants must go to https://www.yervana.com (the “Website”) and complete Sign Up during the Contest Period (the “Website Entry”).
In addition, you will be required to signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Rules by clicking the acknowledgement box on the Sign Up Form.
If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to use (or attempt to use) multiple names, identities email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then he/she may be disqualified from the Contest in the sole and absolute discretion of the Sponsor. Your Entry may be rejected if (in the sole and absolute discretion of the Sponsor) the Entry Form is not fully completed with all required information and submitted and received during the Contest Period. The Released Parties (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible entries (all of which are void).
All Entries are subject to verification at any time and for any reason. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purposes of verifying an individual’s eligibility to participate in this Contest; (ii) for the purposes of verifying the eligibility and/or legitimacy of an entry entered (or purportedly entered) for the purposes of this Contest; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purposes of administering this Contest in accordance with these Rules. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of a valid entry in this Contest will be the Contest server machine(s).
DRAW AND WINNER SELECTION
On Tuesday, May 24, in Vancouver, British Columbia, at approximately 1:00 p.m. PT, one (1) eligible entrant will be selected by random draw from all eligible entries received during the Contest Period.
The odds of winning depend on the number of eligible entries received.
Before being declared a winner: The selected entrant will be contacted by email and notified that they are eligible to win. The selected entrant must reply by email within three (3) business days of notification.
The Sponsor or its representative will make a minimum of two (2) attempts to contact the selected entrant (using the information provided on the Entry Form) within seven (7) business days of the Draw Date. If the selected entrant cannot be reached within seven (7) business days of the first notification, or if there is a return of any notification as undeliverable; then he/she may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the Prize) and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such newly selected entrant) until a winner is confirmed or there are no more eligible Entries or by June 20, 2022, whichever comes first. The odds of winning depend on the total number of eligible Entries received during the Contest Period.
Prize
There will be twelve (1) prizes available to be won over the contest period
1x $500 CAD Yervana Adventure Credit – Digital Gift Card
1x $500 CAD Karma Campervans Gift Certificate
1x $500 CAD Flight credit for either WestJet or Air Canada. (The winner may choose their preferred airline. The voucher cannot be split and will be for the total value of $500 CAD).
Prizes must be accepted as awarded and are not transferable, assignable or convertible to cash. No substitutions except at Sponsor’s option. Sponsor reserves the right to substitute a prize or a prize component with one of equal or greater value, including without limitation, but solely in the Sponsor’s discretion, a cash award. Prizes will only be awarded to the person who is the owner of the Account. (If a mutually agreed upon date cannot be confirmed during this time, the Prize will be forfeited in its entirety without any substitution whatsoever. No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Prize or a component thereof with a prize of equal or greater value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. Prize will only be awarded to the person whose verifiable full name and valid email address appears on the Entry Form.)
CONSENT TO SEND COMMERCIAL ELECTRONIC MESSAGES
By entering this Contest, each entrant permits the Sponsor, its agents, promotional agencies, representatives and contest judges to collect the information submitted with your entry and to use it to administer the Contest. If you have also consented to the use of your personal information for marketing and promotional purposes, you agree that the Sponsor may send you offers, promotions and information about its products and services. The Sponsor may communicate with you through various channels, including email, telephone, social media or mail, using the contact information you have provided. We will respect your preferences otherwise recorded with us. You may withdraw your consent at any time. General
Sponsor reserves the right to cancel, suspend, withdraw or amend this Contest in any way, without prior notice or obligation, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Contest Rules. Any attempt to deliberately undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
You acknowledge that the giveaway is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter, and/or Instagram.
